The New York Police Department is in the process of looking into a tragic accident that claimed the life of a 75-year-old man in Central Park on Aug. 3. New York residents may not think of bicycle accidents involving pedestrians as being fatal. Sadly, the jogger was killed in this case. So far, police have not filed any criminal charges, but the investigation is still underway.
According to the report, the victim was engaged in training for the upcoming New York City Marathon, running along East Drive in Central Park, when the accident occurred. Details of the crash were not included in the report, but it has been confirmed the man was struck by a cyclist and knocked to the ground. He suffered a head injury and was taken to a local hospital, where he was pronounced dead two days later.
Police did not issue a ticket or file formal charges against the cyclist and have not released his or her identity at this time. It is unknown if charges will be forthcoming as the investigation is still being conducted. It is also unknown whether the cyclist suffered any injuries as a result of the accident.
It is possible that New York authorities will find no reason to file criminal charges against the cyclist involved in this accident. However, the family of the deceased man may wish to pursue a separate lawsuit against the cyclist, which they are entitled to do in a civil court setting. Evidence that the cyclist’s negligent actions were a direct cause of the man’s death will be required if the family wishes to achieve financial redress for the tragic accident. While bicycle accidents of this nature are rare, the family retains the right to seek judicial relief.
