Seeking Financial Recovery Through a Wrongful Death Suit
Clearly, no amount of money can replace what you have lost. However, pursuing a wrongful death claim can aid in recovering monies for:
- Accident-related medical costs
- Funeral expenses
- Replacement of lost wages
- Loss of support and services
Our Commitment to Public Safety: At our NYC law firm, we are dedicated to making our city a safer place to live and work. By holding parties accountable for unsafe conditions through personal injury lawsuits, we are essentially safeguarding others from having to experience the same trauma our clients have faced.
Change Is in the Air
Currently, New York is one of handful of states that puts significant limits on the financial recovery a family can seek in a wrongful death claim. The New York State law enacted in 1847 currently limits the compensation an attorney may seek on behalf of his client for the loss of a loved one. The amount is limited to financial losses because New York does not currently view anguish or grief as an injury warranting financial compensation.
The “Grieving Families Bill” currently under consideration in the state legislature would make it possible for families to recover compensation for the anguish and grief suffered over the loss of a child or elderly parent who no longer works and thus has little value under current law. Although it has not yet passed, we remain hopeful, as we believe it will be of great benefit to families suffering the ultimate loss.
